Adjustment of Status (AOS) — Green Card from Within the U.S.

Adjustment of Status is the process of applying for a green card from inside the U.S. If a foreign national is already in the U.S. on a valid visa and becomes eligible for permanent residence (e.g. via marriage to a U.S. citizen), they may adjust status without leaving the country.

Eligibility Criteria

  • Must be physically present in the U.S.

  • Must have entered the U.S. lawfully

  • Must be eligible under an immigrant category (e.g., spouse of U.S. citizen)

  • Must not be barred due to unlawful presence, fraud, or criminality (exceptions apply)

Required Documents

  • Approved or concurrently filed I-130 or I-129F

  • Proof of lawful entry (I-94, visa stamp)

  • Marriage certificate (if applicable)

  • Affidavit of Support (Form I-864)

  • Evidence of bona fide marriage (for spousal cases)

  • Medical exam (Form I-693)

  • ID documents (passport, birth certificate)
