An H&C application allows individuals who are not eligible for permanent residence under other programs to request an exception based on compelling humanitarian reasons. It is often used by people with strong ties to Canada who would suffer hardship if forced to leave.
Must be in Canada at the time of application
Must demonstrate unusual, undeserved, or disproportionate hardship if forced to leave
Factors considered include best interest of children, establishment, health, and integration
Not eligible if applicant has an outstanding refugee claim decision (until 12 months pass)
